Terms of Service

By buying, using, and or redeeming this Pass, supplied by NYC Borough Pass, LLC., a New York corporation (the "PASS"), you, on behalf of yourself, any accompanying minor or another person whom You are responsible for, and Your heirs and assigns (collectively referred to as "You") agree to the following terms and conditions with NYC Borough Pass, LLC.

PASS USE AND VALIDITY

Each PASS is valid for one-time entry to the Destinations included in Your PASS at the time of purchase (a "Destination") unless otherwise noted on the PASS. Each PASS must be used before the expiration date of such PASS or within the time frame purchased from the first redemption (EX: Valid for three days after redemption.). Each PASS cannot be used with other offers and discounts. Persons over the child age specifications must purchase an adult PASS. A PASS is for individual use and may not be used by more than one individual. 

DESTINATION RULES

The Destination is wholly and solely responsible for the care and quality of all goods and services it provides to you and for any and all injuries, illnesses, damages, claims, liabilities, and costs (\"Liabilities\") it may cause you to suffer, directly or indirectly, in whole or in part, whether related to the use or redemption of a PASS or not. You waive and release Bandwango and NYC Borough Pass​, including their subsidiaries, affiliates, partners, officers, directors, employees, and agents (collectively, the \"Released Parties\"), from any Liabilities arising from, related to, or sustained in connection with any act or omission of a Destination, its employees, agents, contractors, and invitees, in connection with your use of the PASS or the goods, services or experiences a Destination provides in connection with the PASS. Services performed by the Released Parties are provided \"AS IS\" without warranties of any kind, express or implied, including any implied warranty of Destinationability or fitness for a particular purpose. A photo I.D. may be required for entry to a Destination. Furthermore, You are subject to each Destination's safety protocols, rules, regulations, and terms and conditions as a condition of entry to each Destination. Destinations may close temporarily, adjust operating hours and/or have irregular operating hours, have limited capacity or sell out, modify what is included with admission, or may otherwise change or be discontinued without notice and liability to NYC Borough Pass or the Destinations. Your entry to a Destination constitutes consent for each Destination and NYC Borough Pass to use any film, photograph, video, or likeness of PASS bearer for any purpose whatsoever without any payment or other compensation to the PASS bearer.

REFUND POLICY

Refunds or exchanges on unredeemed PASS(S) are on a case-to-case basis. Please contact customer service via email at support@bandwango.com, phone (888) 921-5333, or text (888) 921-5333. Restrictions apply.

Customer Service Hours: Monday - Sunday, 6 am P.T. - 6 pm P.T.

Refunds: Refunds may be made on certain unredeemed PASSs only. Refund requests on events, attractions, and certain admissions will not be honored.

Extensions: Purchase Activation Extensions may be made in certain circumstances by reaching out to customer service to explain the reason for the request and will only be considered on unused passes or items that are still within the activation period timeframe. Extension requests on events and certain time-sensitive admissions will not be honored. Extensions will not be made over 365 days of the purchase date.

TERMS

You voluntarily assume all risks and danger of personal injury, exposure to illness, property loss, traffic conditions or weather, and all other hazards arising from, related to, or incidental to Your visit to each Destination, whether before, during, or after Your visit. NYC Borough Pass, LLC, has no responsibility or oversight of the operation of any Destination in the PASS. By purchasing the PASS, You have agreed that Our liability for any claim, injury, loss, theft, tort, or other dispute or controversy ("Claim") that is directly or indirectly related to Your visit to a Destination, any travel to or from a Destination, or Your PASS purchase experience with a third party PASS seller, is limited to a refund of the PASS, regardless of the type of Claim.  You also acknowledge that while current events related to the Covid-19 pandemic are known, future impacts of the outbreak are unforeseeable and shall be considered a Force Majeure event to the extent that they prevent the performance of the PASS's obligations under this Agreement. 

By purchasing the PASS, You agree that any Claim by You or NYC Borough Pass, LLC, against the other, arising from or directly or indirectly relating to the PASS shall be resolved exclusively and finally by binding arbitration under the rules and procedures of the American Arbitration Association ("AAA"). The arbitrator may award money or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's Claim. You agree that Claims made and remedies sought as part of a class action, attorney general, or other representative action are expressly excluded and prohibited and instead are subject to arbitration on an individual basis. The laws of the State of New York shall govern these terms and conditions of Your purchase, redemption, and/or use of this PASS without giving effect to conflicts of law provisions.

By purchasing this PASS, You agree to waive and have waived all rights to pursue or participate in a class or collective action or other action or claim in a representative capacity arising from or relating in any way to the PASS, either in any court or in arbitration.
